01 Eligibility & Acceptable Use

Eligibility

You must be at least 13 years old to create an account or use social features of the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian, subject to applicable law.

Acceptable Use

You agree to use the Service only for its intended purpose. You agree not to:

• Use cheats, automation tools, bots, exploits, or unauthorized third-party software to gain an unfair advantage;
• Reverse engineer, decompile, or disassemble the Game except as permitted by applicable law;
• Access or attempt to access accounts, servers, or data that do not belong to you;
• Interfere with or disrupt the integrity or performance of the Service, including through denial-of-service attacks or exploiting bugs for unfair advantage;
• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.

02 Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to notify us promptly at lastspiregame@gmail.com of any unauthorized use of your account. Accounts are personal to you and may not be sold, transferred, or shared, except where the Service explicitly enables account-linked features (such as alliances). We reserve the right to suspend or terminate accounts that violate these Terms.

03 Virtual Goods & Purchases

The Service may offer virtual currency, cosmetic items, subscriptions, or other virtual goods ("Virtual Goods") for purchase or in-game acquisition. The following terms apply to all Virtual Goods:

• No real-world value. Virtual Goods have no monetary value, are not redeemable for real currency, and are not a form of property, currency, or investment.
• License, not ownership. Purchasing or acquiring Virtual Goods grants you a limited, non-transferable, non-sublicensable, revocable license to use them within the Game, subject to these Terms.
• Non-refundable. All purchases of Virtual Goods are final and non-refundable, except where required by applicable consumer protection law or by the terms of the platform (e.g., the Apple App Store) through which the purchase was made.
• No transfer or resale. Virtual Goods may not be sold, traded, gifted outside of features we explicitly provide for that purpose, or exchanged for real-world value.
• Subject to change. We may modify, rebalance, discontinue, or remove Virtual Goods or their availability at any time, including features such as a VIP subscription, without liability to you, except as required by law.
• Loss on termination. If your account is suspended or terminated for violating these Terms, you may lose access to any Virtual Goods without compensation.

All purchases made through the Apple App Store are also subject to Apple's Media Services Terms and Conditions and applicable App Store refund policies.

04 Social Features & User Conduct

The Game includes social features such as in-game chat and alliances. When using these features, you agree not to:

• Harass, threaten, bully, stalk, or intimidate other players;
• Post or transmit hate speech, or content that demeans others on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age;
• Post sexually explicit, violent, or otherwise obscene content;
• Impersonate any person or entity, including Azayim staff;
• Solicit personal information from other players, or share another player's personal information without consent (doxxing);
• Spam, advertise, phish, or solicit real-money transactions outside official channels;
• Engage in any conduct that a reasonable person would consider abusive, disruptive, or harmful to the community.

We reserve the right to monitor, moderate, and remove chat content and other user-generated content, and to mute, suspend, or permanently ban accounts that violate this section, at our sole discretion and without prior notice.

05 Intellectual Property

The Service, including all game content, artwork, code, logos, characters, music, and the name "Last Spire," is owned by Azayim or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license to use the Service for personal, non-commercial entertainment purposes, no rights are granted to you. You may not reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any part of the Service without our prior written consent.

Any feedback, suggestions, or ideas you submit about the Service may be used by us without restriction or compensation to you.

06 Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

To the maximum extent permitted by applicable law, Azayim shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or virtual goods, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

07 Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, or exposes us or others to liability. You may stop using the Service and delete your account at any time by contacting us at lastspiregame@gmail.com. Sections of these Terms that by their nature should survive termination (including Virtual Goods disclaimers, intellectual property, disclaimers, limitation of liability, and governing law) will survive.

08 Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or for legal or regulatory reasons. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice in-game. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
